Compliance
Compliance — adherence to laws, regulatory requirements and internal company rules: customer verification, anti-money laundering, data protection and advertising restrictions.
What is Комплаенс (Compliance)?
Compliance (from English "compliance", meaning conformity) is a set of processes, policies and a function within a company that ensure its activities meet applicable laws, regulator requirements, payment system rules and internal standards. In high-risk verticals this is not a formality: without working compliance, a company risks its license, loss of merchant acquiring, or criminal prosecution of its management.
## How it works
The compliance function turns legal requirements into concrete procedures: customer identity verification (KYC), business verification (KYB), transaction monitoring for money laundering (AML), sanctions list screening, storage and protection of personal data, and control of advertising and marketing claims. The results are recorded in policies, audit logs and reports for the regulator.
## Where it applies
In gambling and betting, compliance is tied to regulator licenses, player restrictions, self-exclusion and responsible gambling programs. In crypto and fintech, it involves registration with financial regulators, the travel rule and sanctions screening. In dating, it involves age verification and detection of fake profiles. In nutra, it involves restrictions on medical claims in advertising and labeling requirements for dietary supplements.
## What it affects
Compliance determines whether a company can obtain and keep a banking partner or PSP, pass a payment system audit, and enter the target market. Weak compliance most often leads to frozen payouts, refused service and lower approval rates. Good compliance reduces the cost of acquiring a customer through fewer blocks and chargebacks.
## Common mistakes
Typical mistakes include treating compliance as only a legal team's job, checking customers formally without monitoring behavior after registration, not updating policies when the jurisdiction changes, using the same ad campaign setup in markets with different rules, and not documenting decisions on disputed cases.
FAQ
How does compliance differ from a legal review?
A legal review is one-off and concerns a specific contract or question. Compliance is an ongoing control system for processes that operates in every payment, registration and ad campaign.
Does a small affiliate team need compliance?
Yes, at least in a basic form: checking ad materials against platform rules, controlling GEOs and keeping offer documentation. Without it, a team quickly loses accounts and payouts.
Who is responsible for compliance in a company?
Usually a compliance officer is appointed, or an MLRO for AML matters. In small companies the function is often combined with a lawyer's or manager's role, but responsibility for decisions should be formally assigned.
